Terms of Sale

These Terms of Sale ("Terms") apply to every purchase made on https://shop.qwiks.co (the "Store"), operated by Qwiks Co. ("Qwiks Co", "we", "us"), trade licence [trade licence number], [company address].

By creating an account, placing an order or ticking the box at checkout, you agree to these Terms, our License Agreement, our Refund & Cancellation Policy and our Privacy Policy. If you buy on behalf of a company, you confirm you are authorised to bind it.

1. What we sell

The Store sells licenses for digital products made by Qwiks Co: WordPress plugins, WordPress themes, web applications and related software ("Products"), together with access to updates and support for the period described on the plan you buy. Some Products are offered privately to specific customers; these Terms apply to them as well, together with any written quotation or agreement for that work.

2. Your account

You must give accurate details and keep your password secure. You are responsible for activity under your account and for keeping your license keys confidential. Tell us immediately at admin@qwiks.co if you suspect misuse.

3. Prices, taxes and currency

Prices are shown in the Store currency and, where applicable, VAT or other taxes are added and shown at checkout before you pay. Where a payment provider does not support the Store currency (for example, PayPal does not support AED), the amount is converted at the rate displayed at checkout and charged in that provider's currency. Your invoice is issued in the Store currency. We may change prices at any time; changes do not affect orders already paid, and subscription price changes apply only from the next renewal after we notify you.

4. Payment

We accept card payments (processed by Stripe), PayPal and bank transfer. We never see or store your full card details. For bank transfers, use your order number as the payment reference; your license is issued once the funds are received and confirmed. Orders are accepted when payment is confirmed. We may refuse or cancel an order suspected of fraud.

5. Subscriptions and automatic renewal

Monthly and yearly plans renew automatically at the end of each period using the payment method you chose (card or PayPal) until you cancel. You can cancel automatic renewal at any time from My account → Licenses, or through your PayPal account. Cancellation stops future charges; your license stays active until the end of the period already paid. If a renewal payment fails, we may retry it; if it remains unpaid, your license expires at the end of the paid period. Bank-transfer subscriptions cover one period at a time and must be renewed manually.

6. One-time licenses, updates and support

One-time plans are paid once. Depending on the plan, the license may be lifetime or time-limited, and includes updates and support for the period stated on the plan. When that period ends, the software keeps working as described in the License Agreement, and you may renew to receive further updates and support at the renewal price then in force.

7. Delivery

Products are delivered electronically: your license key is shown after payment and emailed to you, and downloads are available in your account. Updates are delivered through the product (for example, the WordPress updates screen) while your license allows it.

8. Support

Support is provided through the ticket system in your account during your support period, usually within one business day. Support covers help using the Product as documented and fixing defects. It does not include custom development, third-party products, hosting issues, or installation on unsupported environments, unless agreed in writing.

9. Refunds

Refunds are handled under our Refund & Cancellation Policy. Nothing in these Terms limits any right you have under mandatory consumer law.

10. Intellectual property

All Products, documentation, designs and branding remain the property of Qwiks Co. or its licensors. Your rights to use a Product are set out in the License Agreement. Custom work transfers ownership only if a signed agreement says so and after full payment.

11. Acceptable use

You must not use the Store or Products for unlawful purposes, to distribute malware, to circumvent license checks, to resell or share license keys, or to harm our systems or reputation. We may suspend accounts and revoke licenses that breach this clause.

12. Disclaimer

Products are provided "as is" and "as available". To the fullest extent permitted by law, we do not guarantee that Products will be error-free, uninterrupted, or suitable for a particular purpose. You are responsible for keeping backups of your data and testing updates before using them on live sites.

13. Limitation of liability

To the fullest extent permitted by law, Qwiks Co. is not liable for indirect, incidental or consequential loss, loss of data, profits or business. Our total liability for any claim relating to a Product is limited to the amount you paid for that Product in the twelve (12) months before the claim.

14. Suspension and termination

We may suspend or terminate your account or licenses for non-payment, chargebacks, fraud, abuse or breach of these Terms. You may close your account at any time by contacting us.

15. Changes

We may update these Terms. The version shown at checkout applies to that order; the version in force when a subscription renews applies to that renewal.

16. Governing law

These Terms are governed by the laws of the Emirate of Dubai, United Arab Emirates. The courts of the Emirate of Dubai, United Arab Emirates have exclusive jurisdiction, without prejudice to any mandatory rights you have where you live.
